What ISTEA did for pedestrian and bicycle
planning, the Americans with Disabilities Act of 1990 (ADA) did
to accessibility for people with disabilities, only more so. The
ADA is a federal mandate to qualifying government entities to
make their facilities accessible. Typically this includes making
sidewalks accessible through the development and implementation
of an ADA Curb Ramp Transition Plan.
The intent is commendable, but oftentimes,
the implementation is problematic. Difficulties arise because
of the continuous evolution of the Act, the broad language of
its mandate, enforcement actions by the Department of Justice,
and civil lawsuits.
